(22) Islamic laws

OUTLINE OF CHAPTER
Difference between shariah and western law: Broader scope of shariah (the content of law), Islamic laws mold the society and not vice versa. Sources of Islamic laws: the Quran, the Sunnah, consensus (ijma), analogical reasoning, schools of law, uniform Islamic legal system.
General principles of Islamic laws: Shariah does not apply to non-muslim, concept of lawful and forbidden, Islamic law and legal hair splitting. Punishment: Divine punishment cannot be applied by humans, flexibility in punishment, death penalty in the Bible, benefit of the doubt.
Immoral sexual conduct, fornication and adultery: Lewd and indecent behavior, punishment for fornication and adultery, stoning to death for adultery, penalty of flogging, rape, false accusation of adultery by the third party, when husband accuses his wife of adultery, false slander against Aishah and innocent until proven guilty.
Oath: Oath is a pledge to God, punishment for breaking oath, when breaking of oath is allowed, atonement for breaking of oath. Bearing witness.
 Murder and manslaughter: Retribution for premeditated murder, restitution for manslaughter, deliberate murder of fellow Muslim, do not kill your children, forgiveness preferred over retribution.
Stealing: Range of punishment (cutting hand or forgiveness).
Dietary laws: Lawful foods, foods of followers of Bible allowed, fresh water-game and seafood allowed, unlawful foods, why pork is not allowed?
Intoxicants, gambling and foretelling future: Why alcohol and narcotics not allowed? Perfection of religious laws
